When You Need a Lawyer to Write Your Will
Most Australian wills are simple, and a quality template handles them well. But the moment your family or your assets stop being simple, a do-it-yourself will becomes the most expensive shortcut your family can inherit.
A will only gets tested once – and you won’t be there to fix it.
Contested estates, confused beneficiaries and accidental disinheritance almost always trace back to a will that wasn’t written for the situation. An experienced estate lawyer anticipates the problems before they exist.
Simple estate and happy to DIY? Our online will kit ($99) may be all you need. But have a lawyer write your will if any of these apply:
- You own property overseas
- You own or part-own a business
- You’re a beneficiary of a family trust
- A “blended” family with children from former relationships
- You have disabled or vulnerable children
- You expect someone may contest or claim on your estate
- You’re getting married or re-married (marriage revokes wills)
- You’re separated or divorced (your will needs rewriting)

What Our Clients Say
My wife and I were not looking forward to the ordeal of making our wills but we found your template easy to understand and very straightforward. The PDF instructions were concise and clear, and the whole exercise took much less time than we had anticipated. We feel a weight has been lifted off us. Thank you so much!
The online Australian Will Kit I received from Legal 123 is an excellent product. I wanted a will that was easy to complete, and all the legalities explained in plain English. This product and Legal 123 service has exceeded my expectations.

Buying a Will Kit from Legal123 was not just buying a will, it also included really thorough and timely advice from Legal123 in response to questions that I had. The Will Kit itself was great and exactly what I needed.
You have saved me hundreds of dollars. I did find it a little confusing at first but help was only a phone call away. Also when I followed the video I had no more problem. I would recommend this for all who need a simple Will made.
A very easy and economical on-line process for writing a WILL. Legal123 'IT' department were also very helpful in guiding me through the process. I would recommend this company.
Excellent Last Will and Testament download, very easy to fill out, takes just five minutes.

Very easy, I finally got around to organising my will and I found your website, it was very convenient and amazingly simple. I had just one question which was emailed and I received an answer within minutes. Many thanks.
Really liked the template as it is comprehensive and quite easy to use. It's quite handy that we can edit and save the main contents in templates until fully satisfied. Also an excellent response on any query I had. Thank you for a fantastic service.

I recommend the Will Kit from Legal123. As someone who has resisted doing his Will (for a very long time) I found the process of working through it at home, in my own time, talking it over with my wife, a really good way to do it. The website was really helpful and when I had a question they came back to me within a day. So now I have a Will, great news for me and my family. Thanks Legal123.

FAQs About Our Will Writing Service
How much does it cost to have a lawyer write a will in Australia?
Traditional firms charge $400-$600 per hour, and a couples’ will package with Power of Attorney and Enduring Guardianship routinely runs past $1,500. Our will writing service is a fixed fee: $699 + GST for simple estates, $899 + GST for complex situations, and $1,899 + GST for a will including a testamentary trust. Every option covers two mirror wills plus both extra documents.
What are mirror wills?
Mirror wills are a matching pair for couples with the same wishes: you leave your combined assets to your partner if you die first, and your partner leaves them to you if they die first, with the same backup arrangements for children and beneficiaries. Every option includes both wills at no extra cost.
Do I need a lawyer to write my will?
Not always. If your estate is simple (a house, car, savings, everything to your spouse and children), our online will kit ($99) is a quality lawyer-drafted template you complete yourself. But if you own a business, have a blended family, hold overseas assets or expect claims on your estate, a lawyer-written will costs a few hundred dollars now and can save your family tens of thousands later.
Why are Power of Attorney and Enduring Guardianship included?
Because a will alone doesn’t cover everything. A Power of Attorney authorises a trusted person to act on your behalf in matters related to your estate, and an Enduring Guardianship authorises someone to make decisions about your living arrangements, healthcare and daily needs if you lose the capacity to make them yourself. Most firms charge separately for these; we include both with every will.
Does marriage or divorce cancel my will?
In most Australian states, marriage automatically revokes your existing will, so if you marry or re-marry you’ll likely need a new one. Divorce doesn’t revoke your will, but references to your former spouse are automatically revoked, which can leave gaps. Either event is the right trigger to have your will rewritten.
Which option should I choose?
Most clients choose Simple ($699 + GST): straightforward family, modest estate, everything to your spouse and children. Choose Complex ($899 + GST) for blended families, business assets, multiple properties or a wider range of beneficiaries. Choose Testamentary Trust ($1,899 + GST) for larger estates, tax planning, vulnerable beneficiaries or likely claims. Not sure? Book a no-obligation call, and we’ll tell you honestly – including if the $99 kit is all you need.
How long does it take? Can it be done urgently?
Your will, mirror will, Power of Attorney and Enduring Guardianship are delivered within 5 working days of your discussion with David. If you need a will urgently – for example before travel or surgery – contact us, and we’ll do our best to fast-track it.
Who will write my will?
David Evans, our wills and estates planning specialist, with more than 12 years’ experience drafting wills for complex situations. You deal with him directly by phone or email. No juniors. No outsourcing.
What is a testamentary trust and do I need one?
A testamentary trust is a trust created inside your will that takes effect after your death. Instead of assets passing directly to beneficiaries, they’re held in trust – which can protect vulnerable or disabled beneficiaries, reduce tax on inheritance income and shield assets from claims, bankruptcy or relationship breakdowns. It suits larger estates and intergenerational wealth planning, and it’s included in our $1,899 + GST option.
What happens after I purchase?
You choose whether to communicate by email or book a call. David asks for basic details (your family, assets and wishes), discusses your situation and recommends how your will should be structured. Your documents arrive by email within 5 working days as PDFs, with clear instructions for signing, witnessing and storing them.
