Further Information
What Is a Codicil and When Should You Use One?
A Codicil is a document that adds to, changes or removes part of a Will after it has been signed. Your Will stays in place, and the Codicil is read with it. The law treats a Codicil like a Will, so it must be signed and witnessed the same way (for example, “will includes a codicil”: Succession Act 1981 (Qld) s 5; Wills Act 1970 (WA) s 4).
How Do You Create a Codicil?
Write it, sign it in front of 2 witnesses who are present at the same time, and have both witnesses sign in front of you. Our Codicil template sets out the wording and the signing page for you.
Does a Codicil Need to Be Witnessed?
Yes. Use 2 adult witnesses who are not beneficiaries and are not married to or the partner of a beneficiary. In some states a gift to a beneficiary who witnesses can fail.
Can I Just Write the Change on My Will?
No. A change written on a Will after it is signed has no effect unless it is signed and witnessed like a Will (Succession Act 1981 (Qld) s 16; Wills Act 1970 (WA) s 10). Crossing words out until they cannot be read can cancel them. Never write on your signed Will.
Where Should I Keep My Codicil?
With your original Will, so your executor finds both. There is no need to register it. For a full new Will, see our Online Will Kit.
Frequently Asked Questions
Is there a free Codicil template in Australia?
Yes, but most free Codicil forms are charity bequest forms or written for UK or US law. Ours is drafted for Australia, includes a video walkthrough, signing instructions and email support, for $39 +GST.
Where can I get a Codicil form?
Right here. Buy the Codicil template, fill in the online form and download your Codicil as a PDF within minutes. No newsagent or appointment needed.
Do you need a solicitor to make a Codicil?
No. No Australian law requires a lawyer to make a Codicil. Solicitors typically charge from about $240 to $500 for one.
Can a Codicil change the executor of a Will?
Yes. Changing or adding an executor is one of the most common reasons to make a Codicil.
Does a Codicil need to be witnessed?
Yes. Sign it in front of 2 adult witnesses who are present at the same time. Neither should be a beneficiary or a beneficiary’s spouse or partner.
Is a Codicil valid in every Australian state?
Yes. Every state and territory applies the same core rules: it must be in writing, signed by you and witnessed by 2 people present together. The template works in all 8 jurisdictions.
How many Codicils can I make?
There is no legal limit, but more than 2 Codicils make your wishes hard to follow. The template covers a first or second Codicil. After that, write a new Will.
When should I write a new Will instead?
After marriage, separation or divorce, when you have new children, or when you want to change how most of your estate is shared.
Can I handwrite changes on my Will?
No. A handwritten change made after your Will is signed has no effect unless it is signed and witnessed like a Will. Use a Codicil instead.
Do I need a Codicil if my address changes?
No. An old address still identifies you and your Will. Do not write your new address on the Will.
Does a Codicil need to be registered?
No. Keep the signed original with your original Will and tell your executor where both are.
